General Terms and Conditions

1. Conclusion of contract

If you wish to use our cloud, you must register by providing your e-mail address, which is also used as your user name, and a password of your choice as well as a name of your choice. There is no obligation to use a clear name; pseudonymous use is possible. We use the so-called double-opt-in procedure for registration, i.e. your registration is only completed once you have confirmed your registration by clicking on the link contained in a confirmation e-mail sent to you for this purpose. The contract for the use of the B.E.G. One Cloud is not concluded until you have registered.

2. Ust of the Cloud

The Cloud is used in particular for communication with other end devices/users in connection with the programming, administration and realisation of projects in which products of B.E.G. Brück Electronic GmbH are used. For this purpose, data can be temporarily stored in the cloud and made accessible to other users. We are entitled to delete data that has obviously been stored inappropriately without any reference to products of B.E.G. Brück Electronic GmbH.

3. Temporary storage

The cloud is only intended for temporary data storage of a few days for specific projects, not for permanent storage of data. We regularly explicitly request users to create backups of the data stored in the cloud outside of the cloud. We are entitled to delete data stored in the cloud after 48 hours.

4. Limitations of liability

(1) We are not liable for the loss of data stored in the cloud as a result of deletion after 48 hours.

(2) We are liable for breach of contractual and non-contractual obligations, in particular due to impossibility, delay, culpa in contrahendo and tort - also for our legal representatives, vicarious agents or assistants - only in cases of intent and gross negligence, limited to the typical contractual damage foreseeable at the time of conclusion of the contract.

(3) These limitations shall not apply in the event of culpable breach of essential contractual obligations insofar as the achievement of the purpose of the contract is jeopardised, in cases of mandatory liability under the Product Liability Act, in the event of damage to life, limb and health and also not if and insofar as we have fraudulently concealed defects or guaranteed their absence.

5. Final provisions

(1) The law of the Federal Republic of Germany shall apply.

(2) Insofar as the customer is a fully qualified merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the place of jurisdiction shall be the registered office of our company. The same applies if the customer does not have a general place of jurisdiction in Germany or if the registered office or usual place of residence is not known at the time the action is brought.

(3) Should individual provisions of the contract with the customer, including these General Terms and Conditions, be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision whose economic success comes as close as possible to that of the invalid provision.
